END USER LICENSE AGREEMENT

DO NOT ORDER, DOWNLOAD, OR USE THE SYMPHONY OF ANIMALS SOUNDS UNLESS YOU HAVE READ AND UNDERSTOOD THIS LICENSE AGREEMENT. BY DOWNLOADING THIS PRODUCT YOU ACCEPT THIS LICENSE AGREEMENT.

  • You understand and acknowledge that you need the full version of Kontakt Sampler (v. 5.8.1 and above) by Native Instruments in order to run this product.  It will not run on the Kontakt Player

  • By installing or downloading these products on your computer you acknowledge that you have read this license agreement, understand  the  agreement, and  agree  to  its  terms  and  conditions.  If  you  do  not  agree  to  these  terms  and  conditions, do not order, download, or install the product. 

  • You acknowledge and agree that YOU ARE OBTAINING A NON-EXCLUSIVE NON-TRANSFERABLE LIMITED LICENSE FOR YOUR USE ONLY—THE SOUNDS DO NOT BELONG TO YOU - the sounds, samples, and programming remain the sole property of Symphony of Animals LLC .   You may not transfer, license or sub-license your rights as Licensee of the sounds without written permission. 

  • You are licensed for two installs of the library on any computer you own that has a current, valid Native Instruments Kontakt license. Please contact us if you would like group or volume license for multiple computers.

  • There are no refunds once downloaded.

    

What You May Do:   You may use these sounds in recordings, compositions, arrangements, public performances, and for other music and media productions that have multiple audio layers.  You may use these sounds in your own musical compositions as much as you like without any need to pay Symphony of Animals LLC or obtain further permission. If you do use these sounds in your music production please credit us with an acknowledgement that "the animal samples used in this recording are from Symphony of Animals” - or similar credit where practicable. 

   

What You May Not Do: It is absolutely forbidden to copy, duplicate, distribute, re-distribute, transfer, upload, trade, or loan this software or any of the contents in any way to anyone. You may not include or give this product, in whole or in part, to an archive, collection, through the Internet, a binaries group, newsgroup, social media, or any type of media, or through a network. You may not resell the product without written permission from us and payment of an additional fee. The sounds and samples contained within this software may not be edited, modified, digitally altered, re-synthesized, or manipulated without direct written consent from Symphony of Animals LLC.  The Symphony of Animals sounds may not be re-used in any commercial sample library or competitive product. 

    

Disclaimers and Conditions:   A right to use Symphony of Animal sounds is granted to the original end-user only, and this license is not transferable unless there is written consent from and payment of an additional fee. The sounds of Symphony of Animals will only work with the full version of Kontakt, v. 5.8.1 and higher, and will not work with Kontakt Player or any other sampler. Licensor will not be responsible if the content does not fit the particular purpose of the Licensee.          

              

Please make sure before installing this item that it meets your needs, as there are no refunds.  Neither Symphony of Animals LLC, nor any agent or distributor, can be held responsible for any direct or indirect or consequential loss arising from the use of this product in whatever form. The prerequisite full version of Kontakt is covered by the End User License Agreement from Native Instruments and is incorporated herein by reference.  The terms of this license shall be construed in accordance with the laws of the United States of America and the State of Florida.  Symphony of Animals may not be returned for any reason - there are no refunds once ordered and downloaded.  



The Nature of the Beast.  The sounds are licensed “as is” without warranties of any kind.  Animals are much more difficult to record, edit, pitch, program, and make musical.  Many animals necessarily lack consistency in timbre, vocalization, and volumes. They have uneven harmonic structures  and uneven distribution of the frequencies and harmonics. Sometimes tonalities can change rather drastically along with volume. You understand that this library may not sound as perfect and consistent as well-tempered musical instrument libraries.

WHAT INFORMATION DO WE COLLECT FROM YOU
When you purchase Symphony of Animals, as part of the selling process, we collect the personal information you send us, such as your name, address and email address. We collect your computer and internet information and purchase history and also the Internet Protocol (IP) address used to connect your computer to the internet which may provide us with information about your browser and operating system.


We use tools available in the Wix™ Platform to measure and collect your session information to measure.  For example, Audience engagements, Site behaviors, Traffic sources, Social Media traffic and Page bounce rates, Demographic information, and website usage data. We also collect Payment details you provide us (including your Credit/Debit Card information). 

WHAT WE DO WITH YOUR INFORMATION
Specifically, we may use data:

  • For our own internal records.

  • To improve the products and services we provide.

  • To contact you in response to a specific inquiry.

  • To improve the website for you.

  • With your permission we may send you emails about new products, services, offers and other things we think might be relevant to you.


WIX™ PLATFORM AND THIRD-PARTY SERVICES
Our website contains links and interactions to other websites. Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party. Please note that we have no control of those websites outside the SymphonyofAnimals.com domain. If you provide information to a website to which we link to, we are not responsible for its protection and privacy.


Our web site is hosted on Wix™.  They also provide us with an e-commerce platform that makes it possible for us to sell and show our products and services to you. Your data is stored in Wix's data storage databases and their e-commerce application.  They store your data on a secure served behind a firewall. If you choose a direct payment gateway to complete your purchase, then they will store your credit card data.  It is protected through the payment Card Industry Data Security Standard (PCI-DSS).  Your purchase transaction data is stored only as it is necessary to complete your purchase transaction.  After the transaction is complete, the data is deleted.  The direct payment gateways adhere to the standards set by the PCI-DSS as managed by PCI Security Standards Council, which is  a trusted standard used by institutions such as American Express, Visa and MasterCard.  For more information you may also want to read Wix's Terms of Use and Privacy Policy.
 

There are third party services that may include: PayPal, Google Analytics, Facebook Pixel and Google AdWords. Always be wary when submitting data to websites. Read their site's data protection and privacy policies fully.
